It has revealed itself <strong>unavoidable<\/strong> when I approached the <strong>phones<\/strong> and the <strong>brands<\/strong> omnipresent in the <strong>life<\/strong> of my <strong>characters<\/strong>. From my first <strong>pages<\/strong>, I had quoted <strong>familiar brands<\/strong> to the general public.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Very quickly, this <strong>question<\/strong> took a <strong>special relief<\/strong>. I had already done the<strong>experience<\/strong>, twenty years ago, from a direct confrontation. After having designed a <strong>marketing concept<\/strong> of <strong>virtual book<\/strong> and opened a <strong>site<\/strong> to promote it, I received a <strong>registered letter<\/strong> of a <strong>law firm<\/strong> ordering me to remove all <strong>reference<\/strong> to my <strong>domain name<\/strong>, yet composed of a <strong>common word<\/strong> in French. This <strong>office<\/strong> represented a <strong>major player<\/strong> of the <strong>digital media<\/strong> and of<strong>Internet<\/strong>. It was the <strong>clay pot<\/strong> against the <strong>iron pot<\/strong> : I gave in and changed <strong>domain name<\/strong>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">Since then, I have been wondering: a <strong>author<\/strong> can he freely quote a <strong>brand<\/strong> in a <strong>narrative<\/strong> ? Every time I see a <strong>movie<\/strong> or a <strong>series<\/strong> exhibiting <strong>logos<\/strong> and <strong>famous names<\/strong>, I ask myself the same question <strong>question<\/strong>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\">So I asked my <strong>virtual friend<\/strong> on this specific point:<br>&quot; In a <strong>movie<\/strong>, if we see the <strong>brand name<\/strong> of <strong>car<\/strong>, of <strong>phone<\/strong> or of<strong>computer<\/strong>, should production request the<strong>authorisation<\/strong> to quote these <strong>brands<\/strong> and get some <strong>rights<\/strong> to film these <strong>objects<\/strong> of the <strong>daily life<\/strong> ? The same <strong>question<\/strong> arises for the use of <strong>popular music pieces<\/strong> or the <strong>quote<\/strong> of <strong>names of personalities<\/strong> or of<strong>known works<\/strong>. \u00bb<\/p>\n\n\n\n<p class=\"has-medium-font-size\">And here is the <strong>summary response<\/strong> :<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Brand names and logos (cars, phones, computers, etc.)<\/strong><br>\u2013 If the <strong>logo<\/strong> or the <strong>name<\/strong> appears fortuitously (for example a <strong>car<\/strong> filmed in the street with sound <strong>visible logo<\/strong>), none <strong>authorisation<\/strong> is not necessary.<br>\u2013 If the <strong>brand<\/strong> is highlighted (close-up, explicit mention in the dialogues), this can pose a problem:<br>\u2022 Risk of<strong>damage to image<\/strong> of the <strong>brand<\/strong> if the <strong>context<\/strong> East <strong>negative<\/strong>.<br>\u2022 <strong>Product placement<\/strong> : when a <strong>brand<\/strong> pays to appear, a <strong>CONTRACT<\/strong> is signed.<br>\u2022 In other cases, it is <strong>careful<\/strong> to ask for a <strong>authorisation<\/strong> to avoid any <strong>dispute<\/strong>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Popular music pieces<\/strong><br>All <strong>copyrighted music<\/strong> requires:<br>\u2022 A <strong>user license<\/strong> (synchronization) with the <strong>beneficiaries<\/strong> (<strong>author<\/strong>, <strong>composer<\/strong>, <strong>editor<\/strong>).<br>\u2022 A <strong>registration license<\/strong> near the <strong>producer<\/strong> if the original recording is used.<br>Without these <strong>permissions<\/strong>, L&#039;<strong>use<\/strong> is illegal, even for a few seconds.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Quotes from famous people<\/strong><br>Mention a <strong>name<\/strong> in a <strong>dialogue<\/strong> is generally <strong>legal<\/strong>, as long as there is no <strong>defamatory remarks<\/strong> Or <strong>liars<\/strong>.<br>L&#039;<strong>use<\/strong> of their <strong>picture<\/strong>, <strong>voice<\/strong> Or <strong>representation<\/strong> requires on the other hand their <strong>agreement<\/strong> or that of theirs <strong>beneficiaries<\/strong>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Famous works (paintings, books, films, etc.)<\/strong><br>If the<strong>artwork<\/strong> fell into the <strong>public domain<\/strong> (often 70 years after the death of the<strong>author<\/strong>), it can be used freely.<br>Otherwise, any <strong>reproduction<\/strong> (visual, <strong>long quote<\/strong>, <strong>music<\/strong>) requires a <strong>authorisation<\/strong> of the <strong>beneficiaries<\/strong>.<\/p>\n\n\n\n<p class=\"has-medium-font-size\"><strong>Best practices for a film<\/strong><br>\u2013 Avoid showing <strong>logos<\/strong> Or <strong>brands<\/strong> centrally without <strong>authorisation<\/strong>.<br>\u2013 Blur or replace with <strong>fictitious brands<\/strong> if necessary.<br>\u2013 Get the <strong>necessary licenses<\/strong> for the <strong>music<\/strong> and the <strong>protected works<\/strong>.<br>\u2013 Take care to avoid any <strong>defamation<\/strong> Or <strong>damage to reputation<\/strong> in the <strong>dialogues<\/strong>.<\/p>\n\n\n\n<p class=\"has-text-align-justify has-medium-font-size\">In <strong>conclusion<\/strong>, this <strong>reflection<\/strong> led me to me<strong>abstain<\/strong> to mention <strong>well-known brands<\/strong> in my <strong>writings<\/strong>.
